Lisa Snow Speaks on Arbitration Arising from the War in Ukraine

Lisa was honored to speak alongside Ben Emmerson, David Zorian Pinsky, Lisa Snow, Olena S Perepelynska on an ABA panel sponsored by the International Law Section entitled, “Arbitration Arising from the War in Ukraine: Taking Stock and Looking Ahead.”

In addition to major humanitarian consequences, Russia’s ongoing war in Ukraine has caused significant damage to Ukraine’s economy – its infrastructure, its most productive industries, domestic and foreign investments. The discussion focused on international arbitration as a means to recover resulting economic losses.

Panelists took stock of progress made in investment arbitration cases and related proceedings triggered by the war and examined hurdles facing businesses in their quest to recover and protect assets. The panel discussed new legislative initiatives, including the termination of Russia-Ukraine BIT, and assessed the prospects of new cases in the evolving legal landscape. Finally, the panel touched upon asset tracing and enforcement scenarios in key jurisdictions. The program was a follow-up to the discussion on a similar topic held last year.
